1. Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of noctaal.com (the "Site") and any purchase you make from Noctàl ("we," "us," "our"). By browsing the Site or placing an order, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live) to purchase from the Site. Our products are intended for adults. By ordering, you confirm that you meet this requirement and that the information you provide is accurate.

3. Products & Health Disclaimer

Noctàl sells dietary supplements, including dissolvable sleep strips. These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease. They are not a substitute for professional medical advice. Consult your physician before use if you are pregnant, nursing, taking medication, or have a medical condition, and discontinue use if you experience an adverse reaction. Keep out of reach of children.

4. Pricing & Product Information

We work to display accurate prices, descriptions and images, but errors can occur. We reserve the right to correct any errors and to change prices, descriptions or availability at any time without notice. If a product is listed at an incorrect price, we may cancel the affected order and refund any amount charged.

5. Orders & Acceptance

Your order is an offer to buy. We may accept or decline any order at our discretion, including if we suspect fraud, an ordering error, or stock issues. A confirmation email means we've received your order, not necessarily that we've accepted it. If we cancel an order after payment, we'll issue a full refund.

6. Subscriptions & Recurring Billing

If you choose a subscription, you authorize us to charge your payment method on the recurring schedule shown at checkout until you cancel. You may skip, pause or cancel anytime from your account or by emailing us; changes must be made at least 24 hours before your renewal date to apply to the next shipment. Subscription pricing and benefits may change with advance notice.

7. Payment

Payments are processed securely by third-party providers through our Shopify checkout. You represent that you are authorized to use the payment method provided. All prices are in US dollars unless stated otherwise.

8. Shipping & Delivery

We aim to ship orders quickly, typically within one business day, with free shipping on US orders. Delivery dates are estimates, not guarantees, and risk of loss passes to you once the carrier takes possession. We're not responsible for carrier delays outside our control.

9. Returns & Refunds

Returns and refunds are governed by our Refund Policy, including our 30-night money-back guarantee, which is incorporated into these Terms by reference.

10. Intellectual Property

All content on the Site — including the Noctàl name, logo, text, graphics, product designs and images — is owned by us or our licensors and protected by intellectual-property laws. You may not copy, reproduce, distribute or create derivative works without our written permission.

11. Acceptable Use

You agree not to use the Site to: break any law; infringe others' rights; transmit harmful code; attempt to gain unauthorized access to our systems; scrape or harvest data; or interfere with the Site's operation. We may suspend or terminate access for violations.

12. Marketing Communications & SMS

If you opt in to email or SMS marketing, you consent to receive recurring promotional messages from us. Message and data rates may apply. You can opt out of email anytime via the unsubscribe link, and out of SMS by replying STOP. Consent to marketing is not a condition of purchase.

13. Disclaimer of Warranties

The Site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee specific results from using our products.

14. Limitation of Liability

To the fullest extent permitted by law, Noctàl and its owners, employees and partners will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Noctàl and its representatives from any claims, losses or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site or products.

16. Governing Law & Disputes

These Terms are governed by the laws of the United States and the state in which our business is registered, without regard to conflict-of-law rules. Any dispute will first be addressed in good faith by contacting us. If it can't be resolved informally, the parties agree to resolve it on an individual basis (not as a class action) in the courts or arbitration forum of that jurisdiction.

17. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date shows the latest revision. Your continued use of the Site after changes are posted means you accept the updated Terms.
